Keep in mind this is not the first time he has taken my headphones but the first time he took them, I didn't bother taking it from him and waiting for him to give it back to me.

I took them now and am waiting for him to admit he took them but i'm not sure what to do.

Basically 6 PM today he comes home and I ask him if he takes took them, he says no and goes and takes a shower, I go into his backpack and there it is, my headphones.
